Terms of Service

These Terms of Service govern your access to and use of Agentry, including agentry.sh, api.agentry.sh, our hosted authentication flows, APIs, docs, and related services. By creating an account, using the API, installing an adapter, sending telemetry, or otherwise using Agentry, you agree to these terms.

1. Who can use Agentry

You must be able to form a binding contract and comply with these terms. If you use Agentry for a company, client, or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. The service

Agentry provides an HTTP API for error monitoring, product analytics, deploy attribution, install verification, and related agent-readable workflows. The service is designed for AI coding agents and technical users who can inspect source code, configure runtime environments, and make informed decisions about telemetry.

Agentry is not a general-purpose security, compliance, APM, infrastructure monitoring, regulated-data, or emergency alerting service. We do not currently provide SOC 2, HIPAA, FedRAMP, PCI, or similar regulated-workload commitments unless we sign a separate written agreement that says so.

3. Accounts, keys, and agents

You are responsible for your account, projects, API keys, DSNs, public query URLs, and every action taken with them, including actions performed by your AI agents, scripts, CI jobs, contractors, employees, and integrations. Keep owner API keys secret and do not expose them in browser bundles, public repos, client-public environment variables, logs, screenshots, prompts, or support messages.

DSNs are ingest tokens for one project. Public query URLs expose the specific publication they were created for. You are responsible for rotating or revoking credentials if they are lost, leaked, shared with the wrong party, or no longer needed.

4. Customer data

"Customer Data" means telemetry, code-related metadata, account data, project data, analytics events, error events, deploy events, sourcemaps, prompts, implementation reports, feedback, and other content you or your systems send to Agentry. You retain ownership of Customer Data. You grant Agentry a limited right to host, process, transmit, store, copy, display, transform, and analyze Customer Data as needed to provide, secure, maintain, debug, improve, and support the service.

You are responsible for what you send. Do not send secrets, raw credentials, private keys, payment card numbers, protected health information, special-category personal data, or other regulated or highly sensitive data unless Agentry has agreed in writing to handle that data type. Configure your apps and agents to minimize personal data and redact unnecessary values before ingest.

Our current public privacy details are in the Privacy page. If these terms and the Privacy page conflict, these terms control for legal obligations and the Privacy page controls as a product disclosure about current data handling.

5. Acceptable use

You may not use Agentry to violate law, infringe rights, attack or disrupt systems, bypass access controls, scrape or exfiltrate data, send malware, spam, deceptive traffic, or abusive load, test stolen credentials, monitor people without lawful authority, or upload data you do not have the right to provide. You may not reverse engineer the hosted service except where allowed by law, resell Agentry as a standalone service, remove notices, or use the service to build a competing managed observability product.

You must not intentionally overload the API, evade rate limits or quotas, create many accounts to avoid limits, or use synthetic traffic in a way that misrepresents product usage or harms other users.

6. Plans, billing, and taxes

Agentry may offer free and paid plans with different event volumes, retention windows, feature access, or support levels. Paid plans are billed through our payment processor. You authorize us and our payment processor to charge the payment method you provide for applicable fees, renewals, taxes, and usage-based or overage charges shown at checkout or otherwise agreed in writing.

Fees are non-refundable except where required by law or expressly stated in writing. You are responsible for taxes, duties, and similar government charges other than taxes based on Agentry's income. If payment fails, we may downgrade, limit, suspend, or terminate access after reasonable notice when practical.

7. Usage limits and retention

Plans may include quotas, rate limits, retention windows, payload limits, fair-use limits, or feature restrictions. We may enforce limits automatically, reject excessive payloads, throttle traffic, reduce retention, or require an upgrade when usage exceeds the plan. Retention windows describe how long Agentry intends to keep covered data, but they are not backup guarantees. You are responsible for keeping copies of data you need outside Agentry.

8. Third-party services

Agentry may rely on third-party providers for hosting, analytics storage, authentication, payments, email, and other infrastructure. Your use of integrations, identity providers, payment processors, deployment hosts, code hosts, PostHog-backed analytics, or AI agents may also be governed by their terms and privacy policies. Agentry is not responsible for third-party services outside our control.

9. Availability, beta changes, and support

Agentry is an early product. We may add, remove, rename, replace, or change endpoints, fields, docs, adapters, plans, limits, pricing, and behavior. We try to keep the API clean and agent-readable, but we do not promise uninterrupted availability, backwards compatibility, or that every workflow will remain available forever.

We may suspend or limit access if we believe your use creates security, legal, operational, billing, abuse, or reliability risk, or if required by law or a third-party provider.

10. Intellectual property and feedback

Agentry and its software, APIs, docs, designs, logos, trademarks, and related materials are owned by Agentry or its licensors. Except for the limited right to use the service under these terms, we do not grant you ownership of Agentry intellectual property.

If you send ideas, bug reports, product suggestions, prompts, examples, or other feedback, you allow Agentry to use them without restriction or compensation. You retain ownership of your Customer Data.

11. Confidentiality

If either party receives non-public information from the other that is marked confidential or should reasonably be understood as confidential, the receiving party will use reasonable care to protect it and use it only for the relationship under these terms. This does not apply to information that is public, independently developed, lawfully received from someone else, or required to be disclosed by law.

12. Termination

You may stop using Agentry at any time. We may suspend or terminate your access if you materially breach these terms, fail to pay fees, create risk for the service or other users, or use Agentry in a way that we reasonably believe is unlawful or abusive. After termination, your right to use Agentry ends, but provisions that by their nature should survive will survive, including payment obligations, ownership, confidentiality, disclaimers, limits of liability, indemnity, and dispute terms.

13. Disclaimers

Agentry is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and that the service will be uninterrupted or error-free.

Agentry provides observability and analytics data for your agents and team to interpret. You are responsible for decisions, code changes, deploys, communications, compliance actions, and business outcomes based on that data.

14. Limitation of liability

To the fullest extent permitted by law, Agentry will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, security incidents caused by your systems, or substitute services. Our total liability for all claims relating to the service will not exceed the greater of $100 or the amount you paid Agentry for the service in the 12 months before the event giving rise to the claim.

15. Indemnity

You will defend, indemnify, and hold Agentry harmless from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your Customer Data, your use of the service, your breach of these terms, your violation of law, or actions taken by people, agents, scripts, or systems using your credentials.

16. Disputes and governing law

These terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws rules. The courts located in San Francisco County, California will have exclusive jurisdiction for disputes relating to these terms or the service, except that either party may seek injunctive relief in any court with jurisdiction.

17. Changes to these terms

We may update these terms from time to time. If changes are material, we will provide reasonable notice through the site, docs, email, product messages, or another appropriate channel. Continued use of Agentry after updated terms take effect means you accept the updated terms.
